Booking Terms & Conditions
Reservations made through Puntify between Customer and Merchant
PLATFORM ROLE
Puntify is a technical intermediary that enables Customers to book services and facilities (e.g. tables, appointments, sunbeds, umbrellas, parking spaces) offered by independent Merchants of any sector (restaurants, bars, hairdressers, barbers, beauty salons, beach resorts and similar). The services are provided by the Merchants, not by Puntify. Puntify is not a party to the contract for the service and is not responsible for its performance.
1 — Definitions
- "Platform": the Puntify system (web and app) through which Customers can book services offered by Merchants;
- "Puntify": the operator of the Platform, acting solely as technical intermediary, reachable at info@puntify.it;
- "Merchant": any independent business that offers and provides the booked service (e.g. restaurant, bar, hairdresser, barber, beauty salon, beach resort);
- "Customer": the person who makes a booking through the Platform;
- "Booking": the reservation of one or more services/facilities of a Merchant;
- "Service Commission": the fee borne by the Merchant and retained by Puntify on online-paid Bookings, set out in the Merchant's commercial terms.
2 — Role of Puntify and Relationships
Puntify provides a technological service that connects Customers and Merchants and facilitates Bookings and, where enabled, online payment. The booked services are provided exclusively by the Merchant.
A Booking gives rise to two distinct relationships: (i) between the Customer and Puntify, governed by these Conditions and limited to the use of the Platform; (ii) between the Customer and the Merchant, for the provision of the service, governed by these Conditions, by the Merchant's own rules and by the Merchant's privacy policy.
The Customer is at least 18 years old and is responsible for the security of any access credentials and for the actions performed through the Platform.
3 — Booking and Confirmation
Before submitting, the Customer can review and correct the booking details and is solely responsible for their accuracy (dates, facilities, contact data).
The contract with the Merchant is formed when Puntify sends the written booking confirmation (typically by email). The confirmation is the document entitling the Customer to receive the booked service at the Merchant's premises.
Puntify may refuse or cancel a Booking in case of suspected fraud, error or unavailability, with refund of any amount paid for the cancelled Booking.
4 — Services and Customer Obligations
The Merchant must provide the service as described and is solely responsible for its availability, quality and accuracy. Images and descriptions on the Platform are indicative.
The Customer must communicate to the Merchant, in advance, any medical conditions, allergies or special needs relevant to the service. If such information is not communicated, neither the Merchant nor Puntify can be held responsible for consequences that could reasonably have been avoided through disclosure.
5 — Price, Payment and Commission
Prices are shown on the Platform and may be updated by the Merchant. Where online payment is enabled, it is processed through the payment provider Stripe via Stripe Connect.
- The payment is collected directly into the Merchant's connected Stripe account: the funds belong to the Merchant, who is the seller of the service;
- Puntify retains from the proceeds a Service Commission borne by the Merchant (set out in the Merchant's commercial terms); the Customer pays the price of the service with no surcharge;
- Depending on the Merchant, payment may be for the full amount or a deposit, with any balance payable on site;
- Card data is handled by Stripe and does not transit through Puntify's servers.
Payment is processed by a third party; Puntify cannot guarantee uninterrupted, error-free or instantaneous processing and is not liable for delays attributable to banks or card networks.
No-show: failure to appear does not entitle the Customer to a refund, save for the Merchant's cancellation policy. For "pay on site" bookings the Customer remains bound towards the Merchant for the agreed amount.
6 — Cancellations, Changes and Refunds
The cancellation, change and refund policy (deadlines and whether a refund is due) is defined by each Merchant and shown to the Customer before the Booking. Puntify is not responsible for the Merchant's decisions on cancellations and refunds; any refund is processed according to the Merchant's policy.
Right of withdrawal: for services provided on a specific date or period, the right of withdrawal is excluded pursuant to Article 59(1)(n) of the Italian Consumer Code (Legislative Decree 206/2005) and Article 16 of Directive 2011/83/EU. This does not affect the mandatory rights granted to consumers by law.
7 — Complaints
Complaints about the service must first be addressed to the Merchant, who is responsible for its provision. Puntify offers best-effort support at info@puntify.it but cannot decide on the merits of the service rendered by the Merchant.
8 — Limitation of Liability
Puntify is responsible only for the proper functioning of the Platform's technical intermediation. Puntify is not responsible for the performance of the booked services, which is the sole responsibility of the Merchant, nor for indirect or consequential damages. The Platform is provided "as is" and "as available". Nothing in these Conditions excludes liability that cannot be excluded by law.
9 — Personal Data
Booking data is transmitted to the relevant Merchant to allow the provision of the service. Puntify acts as data controller for the Platform; the Merchant is an autonomous data controller for the service provision. Details are in the Privacy Policy.
10 — Governing Law and Jurisdiction
These Conditions are governed by Italian law. For consumers, the mandatory provisions of the Italian Consumer Code apply, including the jurisdiction of the court of the consumer's place of residence or domicile. Consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11 — Changes to these Conditions
Puntify may amend these Conditions; each Booking is governed by the Conditions in force at the time of the Booking, which the Customer accepts upon completing the order.
